Terms and Conditions for all Spiritual Mentors in this Community
Overview:
The purpose of this agreement is to provide you with a clear structure and guidelines for your opportunity in this community, and to define specific legal aspects of your membership Agreement with SpiritualHelpers.com. As a Spiritual Mentor on SpiritualHelpers.com, you are part of a professionally trained team of spiritual journeymen providing crystal-clear services to people from all walks of life around the world. Overall, if you always respect people at all levels of consciousness and respect your opportunity in setting a standard as a spiritual professional, you will be very successful.
This community was designed with a clear focus on people who are interested in discovering and accelerating their capacity for spiritual freedom, growth and development. There will be many enthusiastic participants and, from time to time, there may be individuals who feel threatened by or express concern over the nature of the spiritual content on our site. As a Spiritual Mentor, it is your opportunity to be a bright, shining light to all souls attracted to our community. Remember to always come from the principles of love, kindness, reverence, respect and true concern in your activities to be of service in our community.
1. Standards. It is imperative that you operate from your innate standards of the good, kind, loving, sharing part of you – your true feelings – and do your best to help maintain a ‘judgment free’ zone in your interactions with all members of this community.
2. Moderation. Part of the role of Spiritual Mentor in this community is the opportunity to help moderate it. It is your responsibility to monitor the user dialog on any articles you publish, and if time allows, support other Spiritual Mentors in moderating the comments on their articles. In so doing, it is your opportunity to always attempt to bring discussions or conversations back into alignment with our Source and the mission / vision of our community. We don’t want advocate heavy censorship, but if a comment is truly inappropriate, it can be flagged and deleted, if necessary. By working together as a team, we can build this community into a tremendous spiritual watering hole and regrouping place for all of us!
3. Inner Wisdom. It is important that you stimulate the wisdom within each individual and not set yourself up as a guru or become a glory seeker. The individual searcher in this community is the single most important ingredient in the whole structure. We are simply people helping people.
4. Being a Wayshower. When it comes to spiritual development, you don’t have to convince anyone they need it, just be a wayshower and point them in the right direction. They will grow right before your eyes.
5. Honesty. Avoid saying or giving the impression you know something you don’t. This also applies to saying you have had spiritual experiences you have not had.
6. Inner Guidance. Always recheck with your Guidance prior to submitting a response to a user’s comment on your article or before posting a comment on another Spiritual Mentor’s article. Ask your Guidance:
- Is my comment appropriate and professional?
- Am I responding from my true feelings or my emotions?
- Am I channeling crystal-clear Spirit or am I channeling or debating with confusion?
- Is it in the best interest of Spirit’s and my big picture that I post this comment at this time?
- Will my response help maintain a safe and nurturing environment in this community?
7. Membership Fees. Your spiritual mentoring membership fees are $30 per month or $330 per year. Your first 60 days of membership are free. Promotional discounts on these membership fees may be offered from time to time. Your membership benefits include the opportunity to:
- contribute to the site content
- publish your own articles on spiritual topics
- publish and promote your upcoming events
- advertise your spiritual services and products
- utilize our Spiritbook community pages to build your own spiritual network
- schedule and moderate online group activities for your apprentices and spiritual searchers
- assist spiritual searchers with forum topics organized by group
- and participate in our mentors-only areas for advanced leadership training, techniques and networking
If you cancel your trial membership prior to the end of the 60-day period, you will not be charged a membership fee and will return to registered subscriber status on the site. You may cancel your mentoring membership at any time and receive a pro-rated refund for any pre-paid amounts remaining on your account. No refunds will be given for membership time prior to receiving your cancellation notice.
8. Benefactors. We are seeking individuals who wish to support the development and expansion of SpiritualHelpers.com through up-front financial contributions for things like future live-video streaming software, internet advertising fees, and paid administrative staff to help run the site. Any individual who is approved to become a Spiritual Mentor may contribute a one-time fee of $1500 for a lifetime benefactor membership on SpiritualHelpers.com. Benefactors will be identified, if they wish, on our About page. However, lifetime memberships will be subject to the termination provisions in Clause 22. If termination were to occur within the first five years of your membership, a refund will be prorated based on the duration of the membership at the annual rate of $330. If termination were to occur after the fifth year of membership, no refund will be given.
9. Article Moderation. It is our intention to maintain professional standards for all article content published by our Spiritual Mentors. Articles you submit will be held in moderation pending review for quality of content, spelling, grammar, readability and appropriateness. All articles must be G-rated. SpiritualHelpers.com will make every attempt to review and approve your articles for publishing within 48 hours of submission. If an article requires significant editing to meet the minimum standards for professionalism, it will be returned to you for revision. If desired, editing services may be purchased from qualified individuals listed under the SpiritualHelpers.com Services tab.
10. Events. You will be allowed to list and promote your individual and recurring events related to the spiritual topics discussed on this website. Listing or promoting off-topic events (i.e. events not related to the spiritual topics on this website) is not allowed. Your submitted events will be held in moderation pending review for quality of content, spelling, grammar, readability and appropriateness. SpiritualHelpers.com will make every attempt to review and approve your events for publishing within 48 hours of submission. Payment for attending your events must be made directly between you and the attendee, or between the attendee and the sponsoring organization, and NOT through SpiritualHelpers.com. If you have turned on the event RSVP feature, you will receive automatic notices by email with the contact information of individuals who reserve unpaid seats, and they, in turn, will receive your name and email address as the event point-of-contact.
11. Links. You will be allowed to list a link to your own website on your Author profile page, and also submit links to other appropriate spiritual websites for approval and publication on our Links page. However, no linking to other websites that are in conflict with our mission, vision or sponsor organizations will be allowed.
12. Products. You may offer spiritual training products, such as books, podcasts, webcasts, e-downloads, etc. for sale through the Products page of this website. Any product ads you place will require your payment of a $5 listing fee, plus $5 per month for running the ad. You will not be allowed to sell products that are not related to spiritual growth and development on our Products page. Your submitted product ads will be held in moderation pending review for quality of content, spelling, grammar, readability and appropriateness. SpiritualHelpers.com will make every attempt to review and approve your product ads for publishing within 48 hours of submission. You will be allowed to place affiliate ads (on which you may earn third-party commissions for click-through sales) for products related to the spiritual topics on this website. You shall not misrepresent the services you advertise or promote through this website. If your product is purchased through the SpiritualHelpers.com shopping cart instead of through your own website, you will notified immediately of the sale and be paid for the proceeds of your sale within 10 business days, less a 15% sales commission.
13. Services. You may offer personal, business or social services that you are qualified to perform through the classified listings on the Services page of this website. Your spiritual mentoring membership fee includes one free services advertisement per year. Any other services ads you place will require your payment of a $5 listing fee, plus $5 per month for running the ad. Advertisement of any illegal activities is prohibited, and all advertising content must be G-rated. Your submitted classified ads will be held in moderation pending review for quality of content, spelling, grammar, readability and appropriateness. SpiritualHelpers.com will make every attempt to review and approve your classified ads for publishing within 48 hours of submission. You will be allowed to place affiliate ads (on which you may earn third-party commissions for click-through sales) for services related to the spiritual topics on this website. Payment arrangements for your advertised services must be made directly between you and your client, and will NOT be handled through SpiritualHelpers.com. You shall not misrepresent the services you advertise or promote through this website. Misrepresentation may include, but is not limited to, activities such as offering Americana Leadership College (ALC) spiritual profiles that you are not trained to administer, or performing ALC spiritual profiles via any means through our website without current ALC certification to administer that profile.
14. Affiliates. We highly encourage direct links from other sites to SpiritualHelpers.com! You may participate in affiliate marketing efforts of SpiritualHelpers.com by linking to the SpiritualHelpers.com site from your own website or any other website. You will receive a 10% affiliate commission on the sale price for any click through from your link at another website to SpiritualHelpers.com which results in a product or membership sale on SpiritualHelpers.com. If you are interested in becoming an affiliate, you may apply through our contact form.
15. Intellectual Property. You agree to respect the intellectual property provided through SpiritualHelpers.com by its sponsoring organizations (Americana Leadership College, Inc.; IPM International, Inc.; Peace Community Church, Inc.; and Wayshowers Community Fellowship; hereinafter collectively referred to as “Sponsors”) and any other authors, including but not limited to registered and common law trademarks owned by Francisco D. Coll or the Estate Francisco Coll-Monge, and copyrights and copyrighted materials owned by Alley Copyrights Inc. and Alley Creative, including published and unpublished works of Dr. Francisco Coll, Francisco D. Coll, Alley Copyrights, Inc. or Alley Creative. You further agree not to use any intellectual property provided through SpiritualHelpers.com for the benefit of third parties without written permission from the owner of the intellectual property. To do so may violate various Federal and State unfair competition laws, as well as Federal Copyright laws and Federal/State Trademark laws. If you want to create or author derivative works from the previously mentioned material and copyrights, you must communicate a plan and proposal in writing to the intellectual property owner and/or Alley Creative, and receive a licensing or collaboration agreement in writing from the intellectual property owner and/or Alley Creative. This is not necessary if the derivative work is a talk, media appearance, or article used for promotion of the intellectual property owner’s or Sponsor’s courses, workshops, and other services.
16. Attribution. Any articles utilizing or quoting copyrighted material on SpiritualHelpers.com must give proper credit to the original author and identify any copyright dates, owners and restrictions at the end of the article. Practices of plagiarism will not be tolerated and will be grounds for immediate removal of the article and termination of your membership as a Spiritual Mentor and Independent Agent of SpiritualHelpers.com.
17. Relationship. You are hereby retained by SpiritualHelpers.com for the sole and limited purposes set forth in this Agreement, and your relationship to SpiritualHelpers.com is that of Independent Agent. You are under no legal obligation to devote any time whatsoever to the affairs of SpiritualHelpers.com and shall be free to dispose of your time efforts and skill and to engage in any other activity, as you, in your absolute discretion, thinks fit, consistent with this Agreement. You shall not, by the terms of this Agreement, be deemed to be or otherwise have employee status with SpiritualHelpers.com and shall in no event be entitled to participate in any benefit plans, arrangements or distributions reserved for employees of SpiritualHelpers.com. Under no circumstances shall you have the power or authority to make any contracts or arrangements, incur any liability or enter into any legal relationship on behalf of SpiritualHelpers.com. You shall be solely responsible for your workers’ compensation, public risk or any other relevant issues. You shall not be paid any fees or royalties for any articles you may submit to SpiritualHelpers.com for publication. Any expenses you may incur through your participation in the SpiritualHelpers.com community are your sole responsibility.
18. Assignment. This agreement shall not be assigned, transferred or encumbered by you to any third party, individual or corporation, without express written permission of Spiritual Helpers.com, or its successors and assigns.
19. Indemnification. You agree to indemnify, defend and hold SpiritualHelpers.com and its affiliates, and their respective directors, officers, employees, shareholders, partners and agents (collectively, the “SpiritualHelpers.com’s Parties”) harmless from and against any and all claims, liability, losses, costs and expenses (including lawyers’ fees on a solicitor and client basis) incurred by any SpiritualHelpers.com Party in connection with: (i) any use or alleged use of the Site under your Member Name by any person, whether or not authorized by you; (ii) or resulting from any communication made or Content uploaded under your Member Name; or (iii) any breach by you of this Membership Agreement. SpiritualHelpers.com reserves the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with SpiritualHelpers.com’s defense of such claim.
20. Jurisdiction. This Agreement shall be governed by the laws of the State of Maine, unless otherwise agreed in writing. Notices under this Agreement must be delivered in writing, via fax, email; certified or first class mail. Notices involving legal concerns via either party that may result in claims or dissolution of the relationship need to be confirmed via certified mail to the last known address of either party.
21. Disputes. The parties shall attempt in good faith to negotiate and resolve any dispute arising out of or relating to this Agreement promptly by confidential mediation under the then current Mediation Procedure in effect on the date of this Agreement before resorting to arbitration or litigation. Unless otherwise agreed, the parties will select a mediator from the CPR Panels of Distinguished Neutrals.
22. Term and Termination. This agreement shall be valid for a period of one year from its acceptance, and must be renewed annually by mutual agreement. With reasonable cause, either party may terminate this agreement, effective immediately, by giving written notice of cause of termination. Reasonable cause constitutes any violation of this agreement including, but not limited to, such acts as infringement of copyrights, trademarks, conflict of interest, site behavior in violation of any of the above clauses, or gross misconduct.
23. General Provisions. In the event any provision or provisions of this Agreement are found to be void or unenforceable, the remaining provisions shall, nevertheless, be binding and this Agreement shall be enforceable as if the void or unenforceable provisions had not been included.
24. Entire Understanding. This written Agreement contains the entire understanding between the parties and may not be altered or amended except in writing, to which SpiritualHelpers may be amenable for reasonable cause.
